Warranty Update

Dear Valued Customer,

As we continue to be faced with ongoing discoveries during the current pandemic of COVID-19, we have developed a new process regarding our Lennox Warranty. The objective for this recent change is to ensure that we are practicing social distancing when possible, allow for a smooth transition to our customers, and protect the safety of all personnel involved.

Moving forward, warranty parts will not be accepted at the store location and the customer will be instructed to hold the part for 60 days. The customer will begin the Warranty process online at Lennox Pros and will receive the next direction from the Lennox Warranty Department.

If Lennox’s Warranty Department requires additional communication from you for a part return or for missing claim information, the claim will be placed in a declined status with a message to contact the warranty recovery team via email. If a part is requiring a return, a shipping label will be provided through the warranty recovery team as well. Please note that if a customer is notified to return the part and does not within the 14-day time frame, gratis replacement parts and/or reversal of credits may occur.

Furthermore, warranty claims may take up to 60 days to fully process. If a part does not require a return, the customer may scrap the item after the 60-day threshold.

SBA Paycheck Protection Program

The United States Small Business Administration launched the Paycheck Protection Program, which is designed to provide a direct incentive for qualifying small and medium-sized businesses to enable them to pay their employees for 8 weeks during the COVID-19 pandemic. An important aspect of this program is that these costs will be fully forgiven if businesses retain full employment or re-hire employees laid off after February 15, 2020 and the funds are used for payroll, rent, mortgage interest or utilities. This program is part of the CARES ACT (Coronavirus Aid, Relief, and Economic Security Act) that was signed by the President on March 27, 2020 authorizing up to $349 billion of forgivable loans. The Paycheck Protection Program is available from April 3, 2020 through June 30, 2020. Information on where and how to apply, as well as additional details, is provided in the attached links below.

Paycheck Protection Program Summary of Terms

Who is eligible for a Paycheck Protection Loan?

Any small business with less than 500 employees, including sole proprietorships, independent contractors, self-employed persons, private non-profit organization, and 501(c)(19) veterans organizations affected by coronavirus/COVID-19, is eligible to apply. Click here to access the SBA Size Standards Tool to determine if your business qualifies as a small business.

Businesses in certain industries may have more than 500 employees if they meet the SBA’s size standards for those industries:

  • Contractors – 238220
    • Plumbing, Heating and Air-Conditioning Contractors
    • Generally < $16,500,000
  • Distributors – 423730
    • Warm Air Heating and Air Conditioning Equipment and Supplies Merchant Wholesalers
    • Small Business Size Standards < 500 employees

What does the loan cover?

Eight weeks of eligible payroll, mortgage interest, rent and utility expenses between February 15, 2020 and June 30, 2020.

Maximum Loan Amount

The maximum loan amount can be up to 2.5 times your business’ average monthly payroll costs but cannot exceed $10 million. Visit the Interim Final Rule for a detailed description of the program including loan examples.

Do I first have to seek other sources of capital?

No. You will, however, be required to make certain certifications, including that you are not receiving duplicative funds for the same uses from another SBA program.

When can I apply for a Paycheck Protection Loan?

For small businesses and sole proprietorships, you may apply starting April 3, 2020.

For independent contractors and self-employed individuals, you may apply starting April 10, 2020.

When is the deadline for applying for a Paycheck Protection Loan?

June 30, 2020. Since funds are limited and will be distributed on a first-come, first-served basis, you are encouraged to apply as soon as possible.

How do I apply for a Small Business Administration Paycheck Protection Program (PPP) Loan?

Complete the Small Business Administration Paycheck Protection loan Application and submit with the required documentation to any existing SBA-approved lender, or through any federally insured depository institution, federally insured credit union, or Farm Credit System institution that is participating. Visit the Find Eligible Lenders tool for a list of SBA-approved lenders.

What documentation do I need to submit with my Paycheck Protection Loan?

The following is a typical example of information your bank may require you include with your loan application:

  • 2019 Payroll – including last 12 months of payroll
  • 2019 Employees – 1099s for 2019 employees and independent contractors that would otherwise be an employee of your business (Note: Do NOT include 1099s for services)
  • Healthcare Costs – all health insurance premiums paid by the business owner under a group health plan
  • Retirement – your company retirement plan funding paid for by the company

Please note: Requirements from each bank may differ. Therefore, it is recommended you check with your bank / lending institution to see what documentation they may require to complete an application.

What can I use the Paycheck Protection Loan for?

You should use the proceeds from the Paycheck Protection Loan on your:

  • Payroll costs, including benefits;
  • Interest on mortgage obligations incurred prior to February 15, 2020;
  • Rent, under lease agreements in force before February 15, 2020; and
  • Utilities, for which service began before February 15, 2020.

Will my Paycheck Protection Loan be forgiven?

The loan will be fully forgiven if the funds are used for payroll costs, mortgage interest, rent and utilities and at least 75% of the forgiven amount is used for payroll. Forgiveness is also based on you maintaining, or quickly rehiring, employees and maintaining salary levels.

What about any unforgiven portion of the loan?

Any unforgiven portion of the loan will mature in 2-years. Payments will defer for 6 months. However, interest will accrue during that period and the rate is at 1%.

What are the terms of a Paycheck Protection Loan?

The main features of a Paycheck Protection Loan include:

  • 1.00% fixed interest rate;
  • 6-month deferment on payments (with interest accruing);
  • Due in 2 years (with no pre-payment penalty);
  • No collateral requirement; and
  • No personal guarantee requirement.

Can I apply for more than one Paycheck Protection Loan?

No, you may not receive more than one Paycheck Protection Loan.

Warranty Claim Process Change

When a warranty claim is filed and the claim is flagged to return the part, due to COVID-19, we are asking customers to hold the failed part and not return parts to Lennox locations. Warranty will contact customers and provide shipping labels for only select parts required back at the time the claim is filed. The selected parts may vary at Lennox’s discretion. Per policy, continue to hold all failed parts for 60 days unless requested to be returned.

Understanding the CARES Act

Hello Valued Partners,

Valued Partners, The CARES Act signed into law on March 27th 2020 is a $2 trillion emergency aid package to provide rapid relief across the United States economy, helping to protect businesses and individuals during governmental social distancing and shelter-in-place mandates.

The law will have the greatest impact on eight main categories: small business relief, unemployment benefits, individual tax relief, business tax relief, energy, healthcare, economic stabilization, and education/student debt. You can find a brief summary of the small business relief included in the CARES Act below. For a detailed summary of each category, please visit our website on COVID-19 at Coronavirus Aid, Relief and Economic Security Act (CARES).

Small Business Relief

  • SBA Loans – Establishes the maximum 7(a) loan amount. to $10 million through December 31, 2020 and provides a formula by which the loan amount is tied to payroll costs incurred by the business to determine the size of the loan. Specifies allowable uses of the loan include payroll support, such as employee salaries, paid sick or medical leave, insurance premiums, and mortgage, rent, and utility payments.
  • Eligibility – The business or 501(c)(3) nonprofit must have less than 500 employees. This includes sole-proprietors, independent contractors, and other self-employed individuals as eligible for loans.
  • Physical Location and Affiliation - Allow businesses with more than one physical location that employs no more than 500 employees per physical location in certain industries to be eligible.
  • Loan Dates and Terms - Defines the covered loan period as beginning on February 15, 2020 and ending on June 30, 2020. Any remaining loan balance will have a maturity of not more than 10 years, and the guarantee for that portion of the loan will remain intact.
  • Interest Rate - Sets a maximum interest rate of four percent.
  • Waivers - Waives the credit elsewhere test for funds provided under this program. It waives collateral and personal guarantee requirements under this program.
  • Loan Forgiveness - Establishes that the borrower shall be eligible for loan forgiveness equal to the amount spent by the borrower during an 8-week period after the origination date of the loan on payroll costs, interest payment on any mortgage incurred prior to February 15, 2020, payment of rent on any lease in force prior to February 15, 2020.

Announcement Regarding Marshalltown Factory

Lennox previously announced two confirmed cases of COVID-19 in our Marshalltown factory – both individuals continue to rest at home and remain in our thoughts for a speedy recovery. Following CDC guidance, employees who were determined to be close contacts with the affected individuals were instructed to self-quarantine to limit further spread of COVID-19. While the number of self-quarantined employees is low, due to the critical nature of those employees, we decided to pause production at our Marshalltown factory. Disinfection of the facility has been completed by a third party service provider following CDC recommendations and OSHA guidelines, and the factory is ready to resume operations when our employees return. We currently plan to resume operations on Thursday, April 9. Our equipment production and distribution network are well-prepared for the summer season. We are fully confident we have product inventory to continue to meet our customers’ equipment needs.

Residential & Commercial HVAC are deemed ESSENTIAL services

State and local governments continue to issue “shelter in place” ordinances as well as work and travel restrictions to slow the spread of the COVID-19 coronavirus. Under these orders, “essential services” have been permitted to remain open, such as grocery stores, hardware stores, medical facilities, convenience stores and gas stations. Additionally, businesses that supply essential businesses with the support or supplies necessary to operate, have also been permitted to remain open.

The Department of Homeland Security’s (DHS) Cybersecurity and Infrastructure Security Agency (CISA) has issued federal guidance to states and municipalities regarding “essential” work. Additionally, on March 16th, President Trump stated,

”If you work in a critical infrastructure industry, as defined by the Department of Homeland Security, such as healthcare services and pharmaceutical and food supply, you have a special responsibility to maintain your normal work schedule.”

Based on the definitions contained in the guidance, the activities conducted by HVACR manufacturing, distribution, installation and service are “essential” and are collectively, a critical infrastructure industry. The continued operation of your business is viewed as “essential” and necessary in order to perform our role in supporting the residential, commercial, and refrigeration end markets.

Lennox International manufactures products that are “essential” to the global response to COVID-19 coronavirus. The manufacture, distribution and maintenance of our products are essential to the continued functioning of all sectors of the economy. Our residential products are necessary to the essential operation of residences and are also applied in smaller commercial facilities such as restaurants, doctors’ offices, convenience stores, nursing homes and rehabilitation facilities. Our commercial HVACR products provide comfort and air filtration to essential commercial buildings (grocery stores, hospitals, data centers and gas stations). Our commercial refrigeration products are essential to the preservation of food, agriculture and medical supplies, such as pharmaceuticals, blood and plasma.

Temporary Drive-Thru-Only Service

Dear Valued Customer,

As you are aware, the current state of COVID-19 discoveries are constantly evolving. With many local governments issuing self- isolation acts, it is important at Lennox that we take extra steps to help eliminate exposure to our employees and customers as health and safety is our number one priority. We are now seeing areas mandating “shelter in place” orders for non-essential business. Often times, HVAC business is considered essential; therefore, we will continue to service the community by temporarily implementing a drive-thru-service-only option for all stores throughout our network effective when stores open Friday, March 20th.

During this transition of drive-thru service, we have defined a process for our Stores network to follow in order to minimize disruption to our customers. The drive-thru process will be as follows:

1. We request that customers call their designated store thirty minutes before arrival. This will allow for staging of product so we can readily service you. Please do not have orders staged for next day pick up.

2. Once the customer arrives at the store location, call the store or drive to the warehouse ramp and prepare for loading. We ask that you identify where you wish the product to be loaded and open any doors. The employee will then load your vehicle and leave a pick ticket for your signature. Before you leave the store, please sign the pick ticket and place it in the designated bin. This process will allow us to practice social distancing.

We have also provided communication to our Supply Chain/Distribution, Customer Service, and Technical Support teams to assist us if needed.

We strongly encourage customers to utilize Lennox Pros for placing orders and utilize your open account or credit card for payment. This will help eliminate cash handling allowing us to avoid potential exposure; however, we will continue to accept cash at this time. If paying with cash, exact change is appreciated, but not required. We will ask that you place any cash or checks, in an envelope that you will mark with your company name. There will be a bin for envelope collection and we will collect and process with each transaction. Additionally, we will still be answering our store phone lines and we encourage customers to utilize their designated Store email address.

Lennox Stores will operate Monday – Friday, 7:30 AM to 4:30 PM only. Our after-hours lines will also remain in effect for emergency service only.

Coronavirus Impact on Lennox Production (Update)

Hello valued partners:

Over the past few days, I have sent a number of communications to you covering different issues regarding the impact of the coronavirus on our business, operations and events. Our goal during this time period is to ensure the health and safety of our employees, families, customers and communities while also executing our business operations to support you, our customers. I wanted to take the time to summarize the steps we are taking to achieve this and navigate through this challenging situation.

Distribution & Availability

Some product and components are sourced from overseas. In particular, we have experienced minor delays in shipments with our Mini-Split products and our S30 & E30 thermostats that may result in limited availability in select locations.

Furthermore, we have not experienced any port disruptions and none of our overseas suppliers’ shipments have been impacted. All other product is running at normal capacity. We have also made adjustments to our current stocking program to allow you the opportunity to secure inventory for the upcoming season. We know with an ever-changing environment and uncertainty that it’s essential we, as your partner, help you mitigate as many risks as possible to allow you to continue to operate your business successfully.

Stores

Our Lennox Stores and Distribution Centers will continue normal operations where possible with added precautions through this crisis. We have taken additional measures and increased standards around cleanliness and disinfecting common surfaces. We are asking our customers not to enter our Stores if they have any symptoms or know they may have been potentially exposed to the virus. We are testing procedures for a safe, no contact, will call delivery to allow us to continue to service customers in a safe, effective manner. As things change, we will update accordingly. The health and safety of our employees, our customers, and their families is our top priority.

Training Events

All instructor-led classes through April 30th have been postponed. The team is currently in the process of contacting all registered customers and working on rescheduling classes at a later date. This includes, BuildAtech, BuildAnInstaller, Master Selling and 1-day Tech training classes. We believe training is essential to growth and development and we encourage you to use full suite of online classes that are accessible 24/7. These online training courses have been used successfully and the feedback we have received on them is exceptionally positive. I encourage you to utilize these resources until we are able to restore our in-person training. If you have any questions, please reach out to a member of the Lennox Learning Solutions team.

Lennox LIVE

Last Thursday, March 12th, we made the difficult decision to cancel our 2020 Lennox Live scheduled for April 7-9 in Las Vegas. We will be refunding the attendee fees for anyone that registered for the event. We are also cancelling any room reservations for those that booked their room through our hotel block with Mandalay Bay. For those that made flight reservations, we recommend you contact your airline and cancel. Most airlines have revised their cancellation fee policies in light of the impact of current health concerns on travel.

We will be looking at sharing all our exciting updates, news and product announcements through virtual formats. The team is looking at the options now so stay tuned for additional information on that front.

Additional Lennox Support

We have asked most of our staff, in particular our Territory Managers and Field Technical Consultants, to minimize in person meetings and customer visits. While our team will be working remotely, they will be fully accessible through phone, e-mail, text and virtual communications.

Coronavirus Impact on Lennox Production

I know many of you are following the continued concerns with the Coronavirus and not only its impact on world health but also the impact on industry. And I’m sure, with the recent news, you’re concerned with how this epidemic may be affecting Lennox production. We do have some product and components that are sourced from China. In particular, our Mini-Split products are sourced from China and components for our S30 & E30 thermostats, while manufactured in Malaysia, do come from a China based sub-supplier. At this time, we are only experiencing minor delays in shipments that may result in limited availability in select locations.

Furthermore, we have not experienced any port disruptions and none of our Chinese suppliers’ shipments have been impacted. Additionally, all other product is running at normal capacity in our facilities. We have also made adjustments to our current stocking program to allow you the opportunity to secure inventory for the upcoming season.

I know, you, like me, pray for a speedy recovery from this horrible outbreak. And I know you understand that we are doing everything in our power to ensure little disruption to your business. We are taking all the recommended, necessary steps to ensure the health and safety of our employees throughout the Lennox family including our corporate staffs, field sales, stores, distribution and manufacturing. This is a top priority for all of us.

Lennox Commercial Remains Open As An Essential Service

Valued Partners,

State and local governments continue to issue “shelter in place” ordinances as well as work and travel restrictions to slow the spread of the COVID-19 coronavirus. Under these orders, “essential services” have been permitted to remain open, such as grocery stores, hardware stores, medical facilities, convenience stores and gas stations. Additionally, businesses that supply essential businesses with the support or supplies necessary to operate, have also been permitted to remain open.

The Department of Homeland Security’s (DHS) Cybersecurity and Infrastructure Security Agency (CISA) has issued federal guidance to states and municipalities regarding “essential” work. Additionally, on March 16th, President Trump stated,

“If you work in a critical infrastructure industry, as defined by the Department of Homeland Security, such as healthcare services and pharmaceutical and food supply, you have a special responsibility to maintain your normal work schedule.”

Based on the definitions contained in the guidance, the activities conducted by HVACR manufacturing, distribution, installation and service are “essential” and are collectively, a critical infrastructure industry. The continued operation of your business is viewed as “essential” and necessary in order to perform our role in supporting the residential, commercial, and refrigeration end markets.

Lennox International manufactures products that are “essential” to the global response to the COVID-19 coronavirus. The manufacture, distribution and maintenance of our products are essential to the continued functioning of all sectors of the economy. Our commercial HVACR products provide comfort and air filtration to essential commercial buildings (grocery stores, hospitals, data centers and gas stations). We Are In This Together – Lennox Commercial’s Commitment To You

We are in this together! COVID-19 is having a dramatic impact on our lives, communities and businesses. Lennox is committed to helping you navigate these quickly changing times.

Lennox has long been a trusted partner who works for contractors across the US and Canada. This week, as mandated shutdowns were announced, we reached out to ACCA, AHRI, ASHRAE, and other industry organizations to provide our endorsement for HVACR to be designated as an “essential service.” It is important to us that you can keep your businesses running through this time period and so we encourage you to take the following actions:

  • Visit our webpage to join industry association campaigns and reach out to local government representatives to discuss HVACR as an essential service
  • Encourage your local municipality to allow continued activity for site inspections and permit issuance
  • Proactively recommend HVAC work in buildings that are currently unoccupied (e.g. schools, restaurants, etc.)
  • Communicate your health and safety protocols to assure customers that you can do the work safely

I reached out to many of you this week and you have made it clear that you are taking health and safety seriously. Your business is as important to us as it is to you; as such, we’d like to offer the following tips from the World Health Organization (WHO) for keeping you, your employees, and your customers safe as you engage in day-to-day business operations:

  • Thoroughly wash your hands and clean shared surfaces, tools, and other business instruments
  • Maintain social distancing (even on the job site) and limit gatherings to fewer than 10 people
  • Implement work from home processes for office staff
  • Encourage anyone with a fever, cough, or difficulty breathing to seek medical care early and to stay at home
